# ON TUESDAY, MARCH 22, 2016, AT 7:30 P.M. THE JACKSON TOWNSHIP COUNCIL HELD ITS REGULARLY SCHEDULED TOWNSHIP COUNCIL MEETING IN THE MAIN MEETING ROOM OF THE MUNICIPAL BUILDING (NO EXECUTIVE SESSION MEETING WAS HELD THIS DATE)
## PLEDGE OF ALLEGIANCE
COUNCIL PRESIDENT NIXON – A moment of silence for the victims and their families of the terroristic attack in Belgium. Also for our first responders here at home and our military overseas that have to deal with these threats every day.
## ROLL CALL:
COUNCILMAN CALOGERO
COUNCILMAN MARTIN
COUNCILWOMAN UPDEGRAVE
COUNCIL VICE PRESIDENT BRESSI
COUNCIL PRESIDENT NIXON
ATTORNEY CIPRIANI
TOWNSHIP CLERK EDEN
## ALSO IN ATTENDANCE: BUSINESS ADMINISTRATOR SCHLEGEL
As Clerk of this meeting, I publicly announce that in compliance with the provisions of the “Open Public Meetings Act” adequate notice of this meeting of the Jackson Township Council has been advertised in the manner prescribed by law.
COUNCILMAN CALOGERO – Thank you for coming out. Waived comments.
COUNCILMAN MARTIN – Please keep everyone and their families in your prayers for the terroristic attack.
COUNCILWOMAN UPDEGRAVE – Thank you for coming out. Waived comments.
COUNCIL VICE PRESIDENT BRESSI – In 2009 the Senate passed March 30th as a dedicated day to “Welcome Home Vietnam Veterans”. This day was formed due to the ugly remarks and being spat on when the Vietnam Veterans received when they came home in the 60s and 70s. I feel it’s a tribute to the Vietnam Veterans and am proud to say when all the overseas terrorist events happened; the Vietnam Veterans were the first to come out making sure our troops were welcomed the right way when they came home. To these Veterans it means a lot so when you see a Vet, say welcome home. It’s always any day to thank and welcome home a Vet for their services. Thank them for having sustained our freedoms that we have today and continuing to sustain those freedoms for us.
COUNCIL PRESIDENT NIXON – Thanks for all the volunteers throughout the town collecting applications for our “No Knock” registry and they are doing a tremendous service to our community. There is nothing more important than the quality of life and the protection of the personal privacy of our residents. We’ve taken a number of steps, in addition to, forming the registry such as enhancing the penalties under it and getting the applications online. We are pleased to announce, thanks to our Administrator, IT Department and Township Clerk Eden, that tomorrow we are expecting to have our registry on-line for access. I thank the Administrator for making that a reality. It is another important step in making sure our residents have access to this tool giving them the piece of mind they deserve on their private property.
A local blog today made comments and they we not true statements. From 1995 to the ordinance that we passed last summer, somehow we eliminated background checks and identification for registrants and that is a misreading of the old ordinance, which only applied then to mobile vendors (food and ice cream trucks). In 1995, we didn’t have an ordinance that referred to real estate vendors. We dramatically amended that ordinance and “no knock registry” to properly define and place limitation on it. We never had a background check and never took something away that we never had. A having a solicitor simply check a box on a form that he/she never had a criminal history, is not a background check. We still ask if they
===== PAGE 2 =====
have a criminal record. We’re looking into the issue of background checks and it’s important to make the people aware that what the people are reading on line is not accurate in the reading of the old and new ordinance.

## PRESENTATION/OVERVIEW OF THE CY 2016 MUNICIPAL OPERATING BUDGET BY ADMINISTRATOR HELENE SCHLEGEL
BUSINESS ADMINISTRATOR SCHLEGEL – The appropriation and presentation of the 2016 Municipal Operating Budget is one of the single most important responsibilities of Administration for any municipality. It’s the State of New Jersey that dictates to us the budget, financial management and practices by all the municipalities. All budgets, financial statements and audits are approved by the Department of Community Affairs. Tonight’s presentation is for the municipal portion only. The estimates are included for comparison purposes.
Administrator Schlegel explained preparation for the budget process begins as soon as the books are closed for the previous year. The Finance Department begins looking at past year trends and current projections to begin forecasting the upcoming budget year. The budget hearings are held by the Business Administrator in November in accordance with State Statute and the Jackson Township Code. The budget continues to develop until the most responsible budget is presented with the ultimate goal of maintaining quality service to our residents while being efficient with the resources available.
Our goals for the 2016 budget are to maintain a diversified and stabilized revenue base to minimize the effects of economic fluctuation as well as an overdependence on any single revenue source. We continue to be proactive in improving efficiencies and streamlining processes for residents and businesses. Identifying areas for further operational improvements and/or cost saving, revenue enhancements for 2016 and beyond. We try to hold the line on operational cost with the goal of minimizing the impact of the Municipal Tax Levy.
We continue implementation of the long-term strategy for municipal debt reduction. I want to complement our Finance Department for being very diligent. As you know, we have just recently had a bond refinance. We want to maintain service levels in all areas of organization and maintain the Township’s physical assets at a level adequate to protect the Township’s capital investments and minimize future maintenance and replacement costs.
Our perennial budget objectors are to provide quality services at an affordable price while enhancing the fiscal stability of the Township. We want to spend within our means for long-term fiscal stability and be reliable on non-tax revenues. 89.57% of the property class is residential, which means residents are bearing a very high burden for the taxes. We’re looking for clean ratables to come in to offset some of that tax burden. Your tax dollars are spent 57% of the tax bill goes to the schools; which the Administration and the Council doesn’t have any power over. The municipal taxes are 21% and our proposed levy for this year is 1.97% or $596,638.78. The proposed appropriations increase of .49% or $201,964.03. The estimated annual tax increase on an average home assessed at $325,748, would be $27.69 annually or $2.31/month or .53 cents/week or .07 cents/day.
A tax levy is the budget appropriations minus the revenues. We anticipate no tax levy cap issue. Appropriation for clarification is what the municipality tends to spend on operations and the levy is what the municipality intends to raise their taxation of the property owners. Some of the budget impacts are health insurance, pensions, winter storms and personnel. Some significant cost changes are retirement payments, health insurance, legal services, bond principal, snow removal and general liability. Some things that decreased were electricity, accumulated leave and the bond & note interest.
This year the police & fire pension payments went up 11% and the public employee retirement payment went up 6% and that was a hit to the budget. These are exclusions you can take out of the 2% cap. My hat goes off to the Chief Financial Officer and the Assistant Municipal Treasurer for their work with these numbers as we didn’t take any exclusions and when we say it’s is 1.97% is really is 1.97%. For taxes, there was an increase in appropriation of the .49% and the anticipated revenue was down. The amount to be raised by taxation is the 1.97% which is $596,638.78. The tax impact for 2016 acquaints to .49% over the 2015 adopted budget amount. If adopted, this budget will
===== PAGE 10 =====
result in a .009 cent municipal tax increase. Some of the anticipated sources of revenues that are going to support the municipal budget are the surplus, municipal revenue, state aid, and local taxes. Referring to the slide, the percent utilized from 2010-2016 is the percent going down each year. In 2010 they used 95% of their surplus and we’re now using 57%. The appropriations are broken down with salary and wages are $18,592,256 and the other expenses are $23,200,452.58 with a grand total of $41,792,708.61. The bulk of the money is being used for public safety and broken down into the departments. The salaries are broken up by public safety, general government and public works. Capital expenditures are the expenditures that create future benefits and incurred when a business spends money to buy fixed assets or to add to the value of an existing fixed asset with a useful life that extends beyond the taxable year. Capital expenses are generally used to acquire or upgrade a physical asset such as equipment, property or land. These are costs that cannot be deducted in the year which they were paid or incurred and must be capitalized over several years. The costs are normally amortized over the life of the assets to 20 years. Capital projects are identified as discussed between the departments and management. Funding sources and priorities are identified based on Council and staff input.
This year the capital requests are $2,089,000. Through the slide, Administrator Schlegel explained how it is broken down. The driving principles deciding this budget are living within our means, creating a more intensive customer-centered culture, supported high performance, accountability and our organization. The tax collection rate was 98.54%. The 2016 Municipal Purpose Tax, the only portion of the property taxes that the Mayor and Council are responsible for, is estimated at 20% of your total property taxes. Again, the Board of Education makes up the largest portion of property taxes at 57%, County is 15% and the Fire Districts are at 4%.
Jackson Township remains one of the premier residential communities in Ocean County. Our positive record of achievement is primarily due to everyone working together for the benefit of the Township. Special thanks to our Township employees and our volunteers who serve on numerous boards and our emergency personnel who continue to be dedicated to our residents. We summit this budget for your consideration.
Respectfully, Michael Reina Mayor and Helene Schlegel, Business Administrator.
## TOWNSHIP COUNCIL COMMENTS
COUNCILMAN BRESSI - referred to the 89.57% of the residential property tax and in 2010 we adopted a new Master Plan. If that Master Plan gets built out, 75% of what is allowed will reduce that residential burden by 13% to 76% and increasing the non-residential up 11% taking it to 23%. It was adopted in 2010 and with the economy it didn’t take off. Anyone in land use has a right to not comply with the Master Plan and go for a variance through the Zoning Board. On December 30th, the State didn’t approve the Permanent Extension Act and can’t do it now; it’s dead. There have been approvals out there for a lot of commercial properties and these people are allowed through the Permanent Extension Act by the State, to hold these approvals in their pockets and not do anything. With the act coming to a dead end, they’ll either be coming in for extensions and/or putting shovels in the ground or lose their approvals. Since 2006, there is more commercial approvals at the Planning Board than residential. A lot of building is happening now. I hope that if things carry through with the Master Plan and we’ll be looking at it again next year, it will allow for that increase in non-residential and decrease in residential. In doing the Master Plan, we really watched all the environmental concerns. The Master Plan is the blueprint of your town in the future. Looking at land use, long-term is what controls your taxes and this Master Plan does allow for that reduction. If you look on Cooks Bridge Road, you’ll see a Dentist’s Office coming in and County Line Road has a lot of commercial going up and Mitch Leigh is moving forward. Within the next 4-5 years, you’ll see a change in that.
COUNCILMAN CALOGERO - stated the Mayor and Administrator put together a very
fiscally responsible budget. The retirement payments and health insurance are out of our
control, which Administrator Schlegel did a good job explaining the differences of in and
===== PAGE 11 =====
out of the cap. We stayed at 2% without the exclusions. We added Police and services and I’m very happy with it.
COUNCILWOMAN UPDEGRAVE - agrees with the comments made by Councilman Calogero. It’s amazing you were able to keep the exceptions in there and stay under the 2%. Very good job.
COUNCILMAN MARTIN – I spoke to the Administrator this morning about this and we’re finally building our surplus. The economy is helping a little bit and the fiscal responsibilities have been put in place over the last several years. Other towns say we’re not raising taxes but are bleeding their surplus to do it; we’re not doing that. I commend you for a job well done and Ms. Pinkava and her entire department.
COUNCILMAN BRESSI – stated he concurs with the wonderful comments about the budget and our Administrator and Finance Department. Yes, I do disagree with the COLA and haven’t voted for it yet in my life. Everything is within the 2% and it’s key that we’re building a surplus.
COUNCIL PRESIDENT NIXON – A number of important issues were raised an increase of $596,638.78 in the levy in which $344,000 of that is dictated by the State of New Jersey. Retirements are payments into the State retirement funds and for the health benefits plan, you get a bill from the State and you can’t say you’re not paying for it. 57% of the increase is State mandated and we can’t do anything about it. State Aid has been frozen for so long that the type of allowances we should be getting from the State based on monies we’re sending to Trenton. Some things should be coming back to municipalities and it doesn’t and that is a problem that the leadership in Trenton has to address. Looking at the surplus issue, other towns raid it in order not to increase. To say we are only spending 57% of that surplus as opposed to 95% six years ago is fiscally conservative. When you look at all we’ve done to expand services and increase our services to a more customer friendly form of government under the Administrator, we’re heading in the right direction. With Councilman Bressi’s point of more ratables in the town in the right places is the way to offset that number and we have to do a better job. I believe we are doing that. I look forward to the discussion and thank you for the presentation.

## PUBLIC COMMENT, ANY TOPIC
KELLY KANIS – 35 VILLANOVA DRIVE – Thank you for putting the solicitor’s online for the No Knock tomorrow. She confirmed if it still requires a sticker. Township Clerk Eden explained the sticker is a “check and balance” and the existing code requires my office update the no-knock registry monthly, however, we try to do it more often than that. If a solicitor sees the sticker, they shouldn’t approach (regardless of being on the most current registry). You’ll have to come in for the sticker or submit $1 through the mail and we will verify that an application has been submitted on behalf of that resident. The new online application is in a fillable format, however, this online registration will not result in a decal. It could take up to 30 days to place their names on that registry which is stated on the new application form. Council President Nixon stated it is for disclosure purposes. Township Clerk Eden stated it wasn’t on the initial form because most were handled in person. Ms. Kanis asked if Council could look into doing an email blast or a robocall to let the public know. Council President Nixon stated he would defer to Administration. Administrator Schlegel stated our reverse 911 is an emergency notification system which is not appropriate for this use. Ms. Kanis said she remembered getting calls for Jackson Day, etc.
Administrator Schlegel stated it’s been this way since she began and it has not been used for anything other than an emergency. Administrator Schlegel stated the email blast is something we could look into. Council President Nixon stated anything that’s possible to spread the word.
DENISE GARNER – 14 EVERGREEN COURT – Today is Water Day and I’m concerned about the water. There was a statement made last night that they don’t care about water. Water Day is an international observation and provides opportunity to learn about
===== PAGE 32 =====
water related issues. New Jersey needs to plan to make sure we have enough to meet our human and ecological needs. Without this plan many municipalities are working in the dark.
Municipalities must apply for and receive water allocation permit which sets limits how much water a town can take from its aquifers. The last time this plan was updated was 20 years ago and our population has increased. Surrounding municipalities are taken into account particularly Lakewood with a population close to 300,000. Clean drinking water is a fundamental right to you and all New Jersey citizens. An ample supply of clean water is critical to agriculture production. If you care about Jackson Township and its citizens, businesses, economic and overall quality of life then it needs to have the right information and planning implemented. I have a water resolution/plan to support the clean water supplies. With Jackson 21 coming in, there will be a high utilization of water. I understand the MUA has a system in place with a cumulative effort and we’ll know where we stand. Today, India is out of water and their deep aquifers are dry. Without the proper calculations and with over development, we are eliminating our wetlands and encapsulating our recharge areas, we will not be able to have that supply in the future. Ultimately, you’ll be increasing the price to the residents and there won’t be a supply.
Councilman Bressi stated the Township doesn’t charge for water and it’s the MUA. The commercial lanes in the Master Plan in 2010 were worked with the DEP, County and MUA. Three years ago, the MUA got allocations from the DEP that would take us out 20 years for water. All the commercial lanes have the 208 Plan included in it and it’s been looked at. This was all addressed by the MUA and the DEP. If you go to the MUA, you can look at their 208 Plan, which is their Master Plan. Ms. Garner stated that plan is already almost 10 years old; Councilman Bressi stated he said it’s for 20 years. The Master Plan was approved in 2010 and has not been built out. The water allowances for when it is built, has occurred. The MUA serves about 12,000 units in the Town. The MUA has the water allocations for Jackson 21, which was given from the DEP. Ms. Garner stated she understands but with all the development happening there is not an actual calculation. We are drawing out from 3 deep aquifers and other municipals are as well. Councilman Bressi agreed and stated that’s why we go to the DEP, they handle those calculations. Council President Nixon stated we don’t make decisions in the dark and have consultations with the MUA and DEP. Ms. Garner stated she’s served on the Environmental Commission for 14 years and has the knowledge of water and wetlands. Ms. Garner stated if Council wants this township to survive, you need to look at this. Ms. Garner stated don’t be surprised if there’s no water in 20 years.
Ms. Garner referred to the pipe coming from Chesterfield down to McGuire AFB and stated she’s still waiting for Administrator Schlegel to get back to her for a meeting. This is an urgency as they are going through 2 large Superfund plumes and will be de-watering the entire area to put this pipe through. By them going through areas of groundwater, it will not be able to charge back into the ground. Administrator Schlegel stated she had a meeting with NJNG about a month ago and I have contact information if you would like it. I don’t feel at this point I’m educated enough in the pipeline to give an opinion. Any technical questions that Ms. Garner is asking should be addressed by the proper authorities. Ms. Garner just wanted to bring awareness. She stated she’s aware they will be driving right through the plumes and there are contaminants; those contaminates are moving east to south. Administrator Schlegel repeated again that NJNG is the expert to contact and can pass along the contact information. Ms. Garner stated she’s well informed and felt the Township needs to get involved in this large project as it will have massive impacts to the entire area. The truth is the Joint Base really doesn’t need it. I hope the Township would give some kind of comment in protecting the Township and the quality of life for the people who live down in that area. Council President Nixon appreciated Ms. Garner bringing this forward.
BONNIE BARRINGTON – 930 HYSON ROAD – Thank you for your swift action on passing Ord. 07-16. I was truly impressed from my initial email and having several Council members call me; it really means a lot to me personally. Thank you again for what you have accomplished as you saved a lot of lives tonight on the ban on puppy mill sales for dogs & cats in Jackson stores. You’re now part of 128 bans nationwide and New Jersey will pass Florida this week with the number of bans allowing only the sale of rescue animals in pet stores. Representatives from Pitties and Pals and Friends of Animals United NJ are here; they
===== PAGE 33 =====
save lives by fostering and looking for doctors. Ms. Barrington informed the Council that by passing this Ordinance it has diminished the demand for the supply of these animals and increased the likelihood of having shelter animals adopted. Thank you. Councilman Calogero thanked her for bringing it to Council’s attention and she deserves a round of applause.
RAE ANN WALKER – 2 EVERGREEN COURT – Thanked Administrator Schlegel for a wonderful presentation; it was broken down for everyone and was educational. Regarding the Landlord Registration Act, I’m hoping we can move along with that. Council President Nixon advised that our Code Enforcement Supervisor has proposed several ideas to the Administrator which are being reviewed. I agree with you with the number of rentals increasing in town, we need to have a more aggressive landlord registration. I can tell you that a number of things are being reviewed and hopefully within the next few weeks, we’ll have something to discuss.
Ms. Walker informed there is Court on Thursday and Attorney Cipriani stated this case has been moved to April 8th and I will send out that information. Ms. Walker indicated her concerns are the violations that have been reported to the Township regarding this and pertains to the Code Enforcement Department. A resident called and made a complaint against a Court Order and the Police notified Code Enforcement and it took them 1 ½ hours to get out there. If we’re dealing with the Court Order part then perhaps they can notify the Police Department that they’re unable to get out there quickly. This happened on March 1st and a Mr. Quinn asked for a copy of the complaint/report and as of today, it is still not available. Township Clerk Eden explained Mr. Quinn filed an OPRA request which was received on March 18th which I then sent an email to Code Enforcement requesting they provide the records requested. I immediately received an out-of-office reply stating that our Code Enforcement Officer is on vacation. When I spoke with the Code Enforcement Supervisor today, he felt that this Code Officer had the photographs and we could not retrieve them until they returned from vacation. I then called Mr. Quinn to advise him that I would need an extension until the Code Officer returned from vacation and he seemed to have a problem with that. I suggested he speak with our Code Enforcement Supervisor. Mr. Pieslak advised him he would try to get him everything the day after the Code Enforcement Officer returns from vacation. Attorney Cipriani stated that information had been forwarded directly to me and has been submitted to the Court. So when we do go in and in addition to their request for a stay, we’ll have the proofs that the Township has submitted regarding the violation of the Order of the Superior Court.
Ms. Walker understands that the Officer is on vacation and it appears there is no written report in the 22 days since this happened. There seems to be a question of how pictures are taken. Does the Township issue a camera to Code Enforcement or a phone by the Township and where is the information collected? It can’t be on a personal cell phone because then it becomes the person’s property. Administrator Schlegel believes they are issued a camera as well and if I use my personal cell phone for Township business, the relevant information is not my property. Attorney Cipriani stated it is your personal property and when it is included and submitted in the reports, it becomes the property of the Township. Administrator Schlegel wasn’t aware in this case how the picture was taken but they should be using Township property. Council President Nixon asked if we know if a report has been written. Ms. Walker felt since it’s not OPRA’ble, it wasn’t put together in the fashion it should have been. Council President Nixon felt a lot of it is speculation without knowing all the details.
Township Clerk Eden stated there is a 7-day turnaround on an OPRA as well. It came in on March 18th, and day one would have begun on March 21st and then 7 business days (we're closed on March 25th). Because the one inspector is on vacation, I don't know the specifics, but I gather she has more information. Ms. Walker advised the Code Enforcement Supervisor told me he would get back to me tomorrow about the issues that were transpiring. Council President Nixon doesn't want to speculate but we're all emotionally and financially invested in making sure this is stomped on if there is a violation of the Court Order. It's shameful enough that we have to go back to Court on this. Attorney Cipriani stated with the increase of legal fees attributed to this JR matter and to some extent Affordable Housing; the Court Order that we obtained was clear if we needed to go in on an enforcement action, we can ask for attorney fees. Ms. Walker advised that Mr. Pieslak stated if Code is not available, then he would contact the Police to let them know Code is not available.

MICHELLE SCHNEIDER, 710 PALMER AVE., TOMS RIVER – we’re all from Talimar Estates and are concerned about a commercial property located at Block 2, Lot 30.80 at 534 Whitesville Road, Jackson (the old Sam & Paul Drywall Bldg.). We have seen almost over 200 cars there at one time; also boxes going in and out. It is a very dangerous section on a bend and a curve by the tracks. We would like you to look into this as we wanted to make you aware. Council President Nixon stated it is appreciated and the appropriate authority is the Code Enforcement Office. I ask that you speak to Administrator Schlegel after the meeting and make sure that your complaint can be registered. Ms. Schneider asked if the pictures are necessary to file the complaint and Administrator Schlegel advised no. Council President Nixon thanked her for bringing it to Council’s attention.
