ORDINANCE 31-04

WHEREAS, the Township Committee of the Township of Jackson has determined that Part II, Chapter 51 of the Township Code should be supplemented to add a sentence to Section 51-27 and to add a new section 51-27.1 concerning certified animal control officers;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

SECTION 1. Section 51-27 of the Township Code of the Township of Jackson entitled “Animal Control Officer” is hereby amended to add the following sentence:

All Animal Control Officers employed by the Township of Jackson shall be Certified Animal Control Officers, as defined in N.J.A.C. 8:23A-2.1.

SECTION 2. Part II, Chapter 51, Article IV of the Township Code of the Township of Jackson entitled “Animal Control Officer; Impoundment” is hereby amended and supplemented to add a new section 51-27.1 entitled “Certified Animal Control Officers; powers and duties” as follows:

Section 51-27.1. Certified Animal Control Officers; powers and duties.

• a.A Certified Animal Control Officer of the Township of Jackson who has been certified as an Animal Cruelty Investigator pursuant to N.J.S.A. 4:19-15.16a et seq. is hereby authorized to investigate and sign complaints, arrest violators and otherwise act as an officer for detection, apprehension and arrest of offenders against the animal control, animal welfare and animal cruelty laws of the State of New Jersey and ordinances of the Township of Jackson.
• b.A Certified Animal Control Officer of the Township of Jackson who has been certified as an Animal Cruelty Investigator shall have all the powers and authority set forth in N.J.S.A. 4:19-15.16c.
