Incapacitation: Left to Institution to Define
- State of being unconscious, asleep, or under the influence of drugs and/or alcohol to such an extent that the person cannot appreciate the nature or consequences of their actions
- Intoxicated people can consent.
Incapacitated people cannot consent.
