TOWNSHIP OF JACKSON RESOLUTION 278-2025

AUTHORIZING THE RELEASE OF PERFORMANCE GUARANTEES, 3D ROSE, LLC, BLOCK 8401, LOT 5

WHEREAS, 3D Rose, LLC has previously posted a Performance Guarantee in the total amount of $84,921.00 with respect to their property located at Block 8401, Lot 5 as shown on the official Tax Maps of Jackson Township; and

WHEREAS, the property has a street location of 141 North County Line Road; and

WHEREAS, the developer has requested release of its Performance Guarantees; and

WHEREAS, by letter dated August 13, 2025, Charles Cunliffe, PE, PP, CME, Township Engineer has recommended to the Township Council that the Performance Guarantee of the developer may be released as all bonded items have been installed and completed and acceptable in general conformance with the approved plans; and

WHEREAS, the Ocean County Engineers office authorized final acceptance by way of letter dated July 11, 2025; and

WHEREAS, the Township Council wishes to accept the recommendation of its Township Engineer to release the Performance Guarantees conditioned upon the posting and/or maintaining a two (2) year Maintenance Bond in the amount of $10,615.13.

NOW, THEREFORE, BE IT RESOLVED this 26^{TH} day of August, 2025 by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:

1. The Performance Guarantee previously posted by the developer, 3D Rose, LLC for this project in the total amount of $84,921.00 is hereby released conditioned upon the applicant either posting or maintaining a Maintenance Bond in the amount of $10,615.13.
2. BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided to the following:
1. Charles Cunliffe, Township Engineer
2. 3D Rose, LLC
3. Stephanie Marlin, CFO
4. Beth-Ellen Gencarelli, Deputy Clerk
5. Lavon Phillips, Township Administrator
