# TOWNSHIP OF JACKSON RESOLUTION 276-2025
## RESOLUTION OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY AUTHORIZING A PERFORMANCE GUARANTEE REDUCTION, BURKE DREAMS, LLC, BLOCK 3601, LOTS 19, 33, 34, 35 &40
WHEREAS, Burke Dreams, LLC has previously posted a total Performance Guarantee in the amount of $1,408,710.00 including a bonded portion thereof in the amount of $1,267,839.00 and a cash portion in the amount of $140,871.00; and
WHEREAS, Burke Dreams, LLC has requested a reduction in the amount of said Performance Guarantees; and
WHEREAS, the property is located at Lots 19, 33, 34, 35 and 40 in Block 3601 as shown on the official Tax Maps of Jackson Township; and
WHEREAS, by letter dated August 14, 2025 the Township Engineer, Charles Cunliffe, PE, PP, CME has recommended to the Township Council, following a site inspection, that a substantial portion of the bonded improvements have been installed and are acceptable to warrant a Performance Guarantee reduction from the original Performance Guarantee amount; and
WHEREAS, the Township Council wishes to accept the recommendation of its Consulting Engineer; and
NOW, THEREFORE, BE IT RESOLVED this 26th day of August, 2025 by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:
1. The Township hereby authorizes a reduction in the total Performance Guarantee for this project from $1,408,710.00 to a new total Performance Guarantee in the amount of $422,613.00, which shall include a bonded portion in the amount of $380,351.70 and a cash portion in the amount of $42,261.30.
2. The Council notes that the above calculation reflects the maximum allowable reduction per the New Jersey Municipal Land Use Law which requires that no less than 30% of the original bond amount remain in place until final acceptance.
BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided to the following:

3. Burke Dreams, LLC
