"text": "has been defined in a neighbourhood plan) but will related to a settlement. When these criteria are not met, CDP policy 10 is applicable. As stated in the paragraph, CDP policy 10 states that development in the countryside will not be permitted unless allowed for by specific policies or when it meets the requirements identified within the policy.\\nParagraph 4.8\\nAcknowledging the policy approach set out in CDP policies 6 and 10, the Respondent objects that a village envelope is not necessary or justified in Brancepeth. The inclusion of such a policy is contrary to the approach to development set out in the County Durham Plan and is an example of a policy which seeks to limit development generally and housing development specifically, contrary to Section 99 of the LURA which is now in force.\\nFollowing on from the above, the BNP Village Envelope Background Paper September 2025 states in para 4.2 that there are no extant permissions or pending applications for residential development on the edge of the village. Paragraphs 4.3 & 4.4 and the associated Tables 1 and 2 go on to consider possible housing sites. Four sites, 4/BH/02, 4/BH/03, 4/BH/04 and 4/BH/05, are discounted they being stated to be detached from the settlement. Two sites 4/BH/01a – Land South of Station House and 4/BH/01b – Land South of Station House are both assessed as being unsuitable and both are excluded from the proposed settlement boundary. It is evident from Section 5 of the BNP that the draft village envelope has been tightly drawn to limit any future development. This is not sustainable, is not a Plan, is likely to perpetuate the aging and declining population being experienced. Additionally it does not deliver wider benefits beyond restraint. Amongst other things this is contrary to basic conditions a), b) and c) and Section 99 of the LURA.\\nPolicy 1\\nAcknowledging the policy approach set out in CDP policies 6 and 10 the Respondent objects that a village envelope is not necessary or justified in Brancepeth.
