It is to be taken into account in the preparation of the Neighbourhood Plan.\\n\\nInitial Comment\\n\\nSections 98 and 99 of the Levelling Up and Regeneration Act (LURA) 2023 came into force on 25 March 2026.\\n\\nSection 98 sets out that neighbourhood development plan policies may relate to the amount, type and location of development in the area. It also states that neighbourhood plans may also include details of infrastructure, affordable housing and design requirements.\\n\\nSection 99 of the LURA sets out that neighbourhood plans must not have the effect of preventing the delivery of development proposed in local plans, or that would provide housing. Another condition requires that a neighbourhood plan must not result in less housing than would have been provided if the plan did not exist.\\n\\nCastle Estates (Brancepeth) Ltd considers the Brancepeth Neighbourhood Plan (2026 – 2039) Submission Draft, the ‘BNP’, should be assessed against the latest legislation which is now in force.\\n\\nParagraphs 2.5 – 2.6\\n\\nCastle Estates (Brancepeth) Limited have made a positive contribution to that which has made the village what it is today. This includes from development coming forward over the years and through supporting events in the village including on land the Respondent owns which includes land between / adjacent to St Brandon’s Church and Brancepeth Castle.",
