"text": "COUNCUL PRESIDENT UPDEGRAVE thanked Mr. Russo for coming and updating everyone on COAH rules. Mr. Russo stated there usually wasn’t good news when it came to affordable housing and it didn’t look good for Jackson. He previously spoke of the rules that were proposed and COAH had since adopted those rules and they would go into effect once they were published on June 2nd. He stated once the rules were proposed they were amended and those amendments would be published June 16th and the public would have a 60 day comment period and then COAH would act on those rules in August. He stated the rules substantially changed the rules they adopted and Jackson still didn’t have binding rules they could do anything with. He spoke of some changes towns had to comply with and felt Jackson couldn’t come up with a 3rd round plan because they didn’t know the status of the growth share ordinance that make up the backbone of the 3rd round plan. Council President Updegrave confirmed the rules were the ones that went back to 2004 and the plan they follow to complete the 1st and 2nd rounds. Mr. Russo stated he didn’t know if they could capture all or any of the affordable housing units that developers were obligated to provide and the town would get an obligation going backwards, based on those approvals and it may take years. He asked the Council to file a series of challenges with the appellant division seeking guidance and to also file another application with the appellant court stating that Jackson doesn’t have to comply with the 3rd round rules until the growth share is resolved and litigation is resolved and when current legislation that is being proposed is resolved. He said when Jackson puts together a plan it should be based on rules that couldn’t be appealed. Council President Updegrave thanked him for all the information he provides the Council and the work he does for Jackson. He in turn thanked Mayor Seda and the Council for allowing him to take necessary action to protect the town. Councilman Martin stated Mr. Russo did a great job and thanked him."
