"text": "gotten some technical comments. If they are successful in getting approval here tonight, that would be one of the outside agency approvals that they are required to satisfy for the application. Mr. Haidi asked if Mr. Macfarlane would be comfortable disclosing what the County Soil District said. Mr. Macfarlane stated that he does not have that letter with him, but they had a series of technical comments that they are going to have to address. Mr. Haidi asked any of the comments were regarding the sedimentation control. Mr. Macfarlane replied that is typically one of their comments and that is an important part of the plan that eventually gets certified by the Ocean County Soil Conservation District. So yes, that is a requirement that needs to be satisfied in accordance with State standards. Mr. Haidi asked if that is prior to receiving final approval or if they can receive final approval under the condition of that. Mr. Shea explained that is an outside agency approval. Municipal Land Use Law states any of the outside agencies can be completed during resolution compliance prior to the zoning permit. So they cannot get a zoning permit unless all of the outside agency approvals occur. The Board makes it conditional that they have to get application approval. That is already built into the resolution. If the Board says yes and the County says no then the applicant has to come back to the Board. Mr. Bressi has learned over the years that the outside agencies want to see what the final project is before they give an approval. If they gave an approval on a preliminary or part of it then they would have to go back and relook at it. They would rather see the entirety of what the Board approved, then they will give their yes or no. Mr. Haidi asked if the applicant got an approval from the sewage authority. Mr. Macfarlane replied not yet, but they have an application that was submitted to the MUA for the water and sewer connections. They have a couple of comments to address with them, but they are required to obtain a final approval from the MUA for the water and sewer service. Mr. Haidi asked for elaboration on the stone tracking pad, the inlet protection device and the stabilization of the disturbed areas. Mr. Macfarlane stated these are not items that he testified to tonight, which are supposed to be the subject of this cross examination, but he was trying to be helpful. What the Ocean County Soil Conservation District and the State Soil Erosion Sediment Control Manual requires is a stone tracking pad at the entrance to the site where the construction vehicles will enter and exit the site. It also requires sedimentation protection for inlets that collect stormwater runoff during the construction period to reduce and hinder sedimentation from occurring on the project. Mr. Haidi asked if they have received any of the County or Municipal approvals that are needed for this final site plan approval. Mr. Macfarlane replied not yet."
