"text": "M r. Silecchia asked if the Board has the option to deny the application. M s. Cipriani said they do not have the option to deny the application. Under certain circumstances they can require a refiling after a certain number of adjournments. M r. Silecchia expressed concern for how to prevent an applicant from doing this again. M s. Cipriani encouraged the Board to take it on a case by case basis and if an application seems too excessive or abusive, they can possibly require a refiling. M r. Heiman said their concern is they have cases on the agenda and when they cancel last minute other applications are pushed off. M r. Heiman said there is a letter for this application from Pinelands, dated January 5, 2026, due to a change CM P is what is requiring the applicant to resubmit, this was a change from the Pinelands and not the applicant. M r. Heiman's point is that it makes sense from the applicant's standpoint that they don't have to send someone to a meeting but indicated the Board concern is with the last minute cancellations. M s. Cipriani advised the applicant waived the 45 days. M r. Martins clarified, the proposal is to give at least 3 day notice or they have to come before the Board and explain reason for postponement. M s. Cipriani agreed. M r. Martins then asked what criteria determines expert witnesses. M s. Cipriani said the Board has people appear so many times and are accepted as professionals by the Board Chair. M s. Cipriani advised, as a Board member, you can question their credentials. M r. Martins asked how the Board determines experts. M s. Cipriani said there various things but they usually put on record that they are certified in the State of NJ, and in addition there is an educational component and experience. M s. Cipriani advised she will put some material together to guide the Board members with this matter."
